AGREEMENT TO TERMS

ONLINE COURSE PROVIDER
1.1 The Online Courses are offered by BA Guide LLC (The BA Guide). Our mailing address is PO Box 15, Neenah, WI 54956.
1.2 We commit to delivering Online Courses with due diligence and competence.
1.3 We may collaborate with subcontractors or third parties for course facilitation. You accept that The BA Guide’s responsibility is ensuring these parties are competent. We are not liable for their individual actions or omissions.
1.4 The BA Guide continuously strives to provide fresh and current content. To this end, content may be updated, added, or removed at any time, at the sole discretion of The BA Guide, to maintain its relevance and accuracy.
2.1 Here are some key terms used in this document:
- Additional Study Materials: Online or physical materials not covered by the Course Fee.
- Brochure: Any material, digital or physical, detailing our Online Courses.
- Course Fee: The amount for an Online Course, including taxes.
- Course Materials: Resources provided during an Online Course, typically digitally.
- Online Course: Any course we offer online.
- Website: thebaguide.com or any domain we operate.
- You: The individual enrolling in the Online Course.
2.2 Singular terms can also imply the plural.
PURCHASING AND CONFIRMATION
3.1 To enroll, provide the necessary details and pay the mentioned amount. Ensure the accuracy of your information.
3.2 By ordering, you agree to the stated terms for that Online Course.
3.3 A binding agreement forms when: (a) You receive our confirmation email with course access details; (b) We receive the full Course Fee.
3.4 This agreement, combined with your order and our confirmation, is the final contract between us. It overrides any prior terms or discussions.
3.5 Check your order confirmation. If there are errors, notify us as per Clause 18.
3.6 Orders with multiple courses are treated individually.
3.7 We reserve the right to decline course purchase offers without explanation.
3.8 We can adjust Course Fees, course details, or withdraw courses any time before finalizing a contract.
4.1 Course Fees and other charges are displayed on our Website, in our Brochures, or informed by our representatives.
4.2 All payments are in USD. The quoted prices include VAT. You bear all currency conversion costs.
4.3 Pay the Course Fee: (a) in full during enrollment; or (b) in installments (when available), as outlined on our platform.
4.4 If opting for installments:
- Ensure timely payments.
- We can automatically deduct payments from your card.
- Update card details if needed.
- Missed payments may result in course access suspension.
- No refunds for already paid amounts unless specified in Clause 5.1
4.5 Installment options are subject to availability and our discretion.
4.6 The total amount may vary based on your chosen payment method.
CANCELLATION AND DEFERRAL
5.1 Within 30 days of receiving our order confirmation email, you can cancel your order and get a full refund as per our 30-day money-back guarantee.
5.2 Cancel orders either via the Website (recommended) or email as per Clause 18.
5.3 Beyond the 30-day period, no refund is available, but this doesn’t affect your statutory rights concerning faulty goods.
ADDITIONAL STUDY MATERIALS (IF APPLICABLE)
6.1 You may purchase additional study materials with online courses (when available).
6.2 Payments for these materials are accepted as described in Clause 4.3.
ONLINE COURSE CONTENT AND ACCESS TERMS
7.1 The Website and/or relevant Brochure detail Online Course content.
7.2 Only the materials and tuition outlined in the course description are provided.
7.3 Online Course access is solely for the purchaser and cannot be shared or transferred.
7.4 You bear any internet charges incurred accessing course materials.
7.5 The BA Guide strictly prohibits inappropriate student behavior.
7.6 The BA Guide can revoke a student’s access to the course without a refund if deemed necessary.
MODIFICATIONS TO ONLINE COURSES OR TECHNOLOGY ENHANCEMENTS
8.1 Online Courses might be updated over time. Any changes related to a course you’ve purchased will be accessible to you free.
8.2 Buying a course doesn’t entitle you to updates made in future course revisions.
TECHNICAL SUPPORT AND ACCESS
9.1 We are committed to addressing access issues originating from our platform. However, we cannot guarantee resolutions for issues that arise due to factors on your side.
9.2 Technical downtime is inevitable, and no breach of contract claims will be entertained during such periods.
9.3 We strive for uninterrupted access but can’t guarantee it. Maintenance, repairs, or upgrades might sometimes necessitate site suspension.
9.4 The BA Guide isn’t responsible for delays or disruptions caused by internet issues, firewall restrictions, telecommunication failures, or browser updates.
10.1 Course materials will be provided as described.
10.2 Ensure the course meets your needs; no specific outcomes or qualifications are guaranteed.
10.3 While we strive for accuracy, courses may occasionally contain inadvertent errors.
10.4 Compatibility with your software or hardware isn’t guaranteed.
LIMITATION OF LIABILITY
11.1 Liability limitations/exclusions don’t apply to fraud, deliberate default, death, or injury due to negligence.
11.2 The BA Guide isn’t liable for indirect losses, income loss, business loss, anticipated savings loss, or data corruption.
11.3 It’s your duty to backup data.
11.4 Our maximum liability is the course fee paid by you.
11.5 Unforeseen circumstances beyond our control absolve us from obligations.
11.6 Each clause in this section is independent and modifiable for validity.
12.1 Online courses are strictly educational. The BA Guide isn’t responsible for how they’re used beyond that.
13.1 Intellectual property rights for the courses remain with The BA Guide.
13.2 Upon full payment, you receive a non-exclusive, non-transferable license for personal use. Unauthorized reproduction or sharing is prohibited.
CHANGES BY US
15.1 Course descriptions provide general expectations and aren’t contractually binding.
INCONSISTENCY OF TERMS
16.1 If inconsistencies between terms arise, this order prevails: (a) Online Courses T&C, (b) Website Use T&C.
17.1 We can recover debt collection costs.17.2 We can update these terms without notice.
17.3 Only we can assign or transfer rights or duties under these terms.
17.4 Official communications should be emailed as described in Clause 18.
17.5 Our contract is in English and not for third-party benefit.
17.6 This contract is under the jurisdiction of the US, specifically Wisconsin.
